I am a county clerk and a notary public. Can I hold both offices?

In most states, the office of notary public and county clerk/county deputy clerk are incompatible under the provision of the state constitution, which generally prohibits the holding of two offices of emolument by the same person. Please consult with an attorney for legal advice.

I just became a district clerk. Do I have to surrender my notary commission?

In some states, the offices of district clerk, deputy district clerk, county clerk, and deputy county clerk are incompatible with the office of notary public under the provisions of the state’s constitution, which generally prohibits the holding of two offices of emolument by the same person.
